Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website airyca.com and the services provided by Zendevr LLC, doing business as Airyca (“Airyca,” “we,” “us,” or “our”). By accessing or using our website or Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
Airyca provides AI-assisted receptionist and customer-retention software for appointment-based businesses, including messaging, AI voice call handling, appointment scheduling, reminders, review requests, and re-engagement features.
2. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract. If you create an account, you are responsible for the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account.
3. Customer Responsibilities and Consent
If you use Airyca to communicate with your own customers, you are responsible for:
- Obtaining and maintaining all legally required consents before any messages are sent to your customers.
- Complying with all applicable laws and carrier requirements, including the TCPA, CAN-SPAM, CTIA guidelines, and A2P 10DLC rules.
- Honoring opt-out requests and providing accurate business information.
- Where you use our AI voice receptionist, providing any legally required notices and obtaining any consents for automated calls and call recording, including under “two-party” or “all-party” consent laws such as California’s.
4. Acceptable Use
You agree not to use the Services to send unlawful, harassing, deceptive, or unsolicited messages; to violate any third party’s rights; or to interfere with or disrupt the Services. We may suspend or terminate access for violations.
5. Messaging and Calls
Messages sent through the Services are subject to our Privacy Policy and the opt-out mechanisms described there. Message and data rates may apply.
Where enabled, the Services answer inbound phone calls using an automated AI voice receptionist, and calls may be recorded and transcribed as described in our Privacy Policy. You are responsible for any call-recording and automated-call notices and consents required for your callers.
6. SMS Messaging Terms
These SMS Messaging Terms apply to text messages sent through the Services to individuals who have opted in.
- Program description. Airyca sends text messages on behalf of business customers to their customers, including appointment reminders, appointment confirmations, post-visit review requests, and occasional re-engagement messages.
- Consent.We only send messages to individuals who have opted in — either by texting a business directly, or by providing their phone number through a business’s booking or contact form with consent to be contacted. Consent to receive text messages is not a condition of any purchase.
- Message frequency. Message frequency varies based on your appointments and interactions with the business.
- Cost. Message and data rates may apply.
- Opt-out. You can opt out at any time by replying STOP to any message. After you reply STOP, you will receive a confirmation and no further messages unless you opt back in (e.g., by replying START).
- Help. For help, reply HELP to any message.
- Privacy. Mobile opt-in information, phone numbers, and consent are never shared with, or sold to, any third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.
7. Fees
If you purchase a paid plan, you agree to the applicable fees and billing terms presented at the time of purchase. Fees are non-refundable except as required by law or expressly stated.
8. Intellectual Property
The Services, including all software, content, and trademarks, are owned by Zendevr LLC or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services per these Terms.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENDEVR LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Zendevr LLC from any claims arising out of your use of the Services, your content, or your violation of these Terms or applicable law (including messaging-consent laws).
12. Termination
We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may stop using the Services at any time.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in California.
14. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance.
